QUOTE: Besides, Mr. Rausa said, a fifth person on the stoop who received a summons wasn’t drinking alcohol at all. She was holding a red plastic cup filled with soda. This is the part that surprised me. The essential problem of citing someone who was not drinking alcohol aside, I thought that you were safe with a cup or glass. At first, I thought to myself, well that is what you get for not using a glass or even a solo cup. I guess the plastic party icon is not the beacon of safety that I thought it was.

I didn't think it was legal to drink on a front stoop or porch. I wonder exactly how the law reads. If it says "in public" that is different from public property. You are still "in public" view even if you're 1 inch inside your property line. You can run around your house naked all you want, but don't try it on your front lawn [:0] Either way, the cops allegedely sound like jerks, but, the article gives only one side of the story so who gives a crap.

The opposite of this is the amount of alcohol in Solo cups at football games. When tailgaiting at the Tennessee VOLS games, the jails could not hold the people the Law would have to arrest for open alcohol. By the way, most campuses in the SEC are "dry" - yeah, right. As long as you don't puke on the Officer's shoes, you won't get arrested at a SEC game. More beautiful ladies in short sun dresses carry the cups than men too. It is a beautiful site these tailgates and football crowds...
