Marble City Brewing Co.

I know that the south in general is not a hot bed for great beer cities, except Asheville, and considering the size of some of the cities down here we lack the quantity of breweries. Now it looks like Knoxville (metro population of 655,400) is getting another brewery - Marble City Brewery. Good news for me.[:)] http://patrickbeeson.com/blog/2010/apr/11/marble-city-brewing-knoxvilles-next-craft-brewery/ according to wikipedia: One of Knoxville's nicknames is The Marble City. In the early 20th century, a number of quarries were active in the city, supplying Tennessee pink marble (actually Ordovician limestone of the Holston Formation) to much of the country. Notable buildings such as the National Gallery of Art in Washington are constructed of Knoxville marble. The National Gallery's fountains were turned by Candoro Marble Company, which once ran the largest marble lathes in the United States.

Garrett, the beer buying public in east Tennessee will NOT buy Marble. This is very similar to when Monster energy drinks sued Rock Art Brewery in Vermont because of VerMonster beer. I'm with ya brother. Totally agree, but how much time would it be until Marble Brewing (NM) realizes they stepped on the wrong toes and bow out of that market? 6-12 months? 18 maybe? In the meantime, Marble City gets the shaft and probably a cease and desist letter and then need to come up with a plan to either a) change the name or b) wait out the storm and then try again, only to hope the wankers at Marble Brewing don't try it again.

This is from my good friends at Bearden Beer Market: Bearden Beer Market: Major Development!! Marble City and Marble Brewery just had a Summit at BBM!! They have decided to co-exist in Knoxville! Marble City is now READY TO START ROLLING OUT BEER!!!!!!!!!!

From Marble City's tweets: "On the way to Bardstown to get some bourbon barrels." Found out that they are doing a bourbon barrel stout. Hopefully they will bottle it and I'll get some for my BPs... Otherwise, join me when they open their tasting room "The Quarry" for some pints.

Not being a legal expert or anything............but I find it hard to believe that if Knoxville is known as the "Marble City", then it would be fair game for any local business to call itself Marble City Flooring, Marble City Motors, etc without anybody from a similarly named 'Marble (no city)' company from a different state having any claim. Reading the letter, one can't help but think that a term like 'marble' is generic enough to be used by anybody, and that any judge could see through the fact that 'Marble' is only selling in Tennessee to give evidence of potential damage. It's times like these where common sense ends up being the loser.
